You acknowledge that by accessing and using this Website www.myvouchers.ie you agree to be bound by the following terms and conditions. Please read these terms and conditions carefully and if you do not accept them, please do not continue using this website.

· You and your are a reference to you.
· User – Means a user that has completed our registration process and created an account.
· Business – Means any participating seller, vendor, trader or dealer that has agreed to make products or services available to users at a discounted rate.
· Coupon – Means coupons used by users to redeem products / services at a discount.
· Deal – Means the product and / or service being offered by a business at a discounted rate and promoted through the website.
· Product(s) – Means any goods that are offered by a business.
· Service(s) – Means any services that are offered by a business.
 
We are an agent connecting users with businesses through the promotion of deals by way of email and / or social media to communicate the deal.
 
We are not responsible for the fulfilment of the terms and conditions of the deal and cannot be held responsible for the failure of a business to complete the terms and conditions of the deal. Furthermore, we take no responsibility for the individual terms and conditions contained in the coupon / voucher as they are set independently by the merchant.
 
By giving over the coupon and payment to the business you are stating that you wish to avail of the product or service and any issues with that product or service should be reconciled directly with the business.
 
In the event of a dispute we will try to mediate between the parties involved where requested to do so, however, we will only act in a facilitation role and cannot be held responsible for the outcome of such facilitation.
 
Unless agreed between the business and us and notified to you, the deal / coupon expires on the date stated on the coupon and cannot be redeemed after such date. Extensions to the validity may be provided if agreed between Myvouchers and Merchant which will provide for longer voucher usability, please contact Merchant if you wish to ascertain if the offer has been extended.
 
In the event that a business ceases trading, we will make every effort to inform you as soon as we become aware of it.
 
You acknowledge that we have not independently verified any of the information contained in third party content and do not independently verify the underlying values listed on the deals. If you discover that information displayed on a deal is incorrect, please notify us and we will endeavor to correct it. You are under no obligation to complete a purchase because you downloaded or printed out a coupon.
 
The number of coupons redeemable by each user in relation to a any deal will be determined by the business offering the deal as well as their own specific terms and conditions of the deal. The coupon / deal is an invitation to treat and you are making an offer to purchase the goods or services when you make contact with the merchant. The decision on completion of the transaction is made between you and the merchant independent of us.
 
By agreeing to the terms and conditions, you agree not to do any of the:
 
· Hack into or attempt to hack in to any part of the Website;
· Transmit any unsolicited advertising, promotional materials or any other forms of solicitation, unless expressly authorised in advance by us in writing;
· Breach any applicable law or regulation;
· Engage in any other conduct that we consider breaches the terms and conditions of this site.
 
Users who, in our opinion, abuse the website or act in a manner that we consider unethical, will be deleted from the database and become ineligible to sign up again.
 
Any user who tried to amend, alter change a coupon is guilty of a violation and we will notify the authorities of any breaches we feel warrant further investigation. In that respect we reserve the right to give out user data as necessary in order to facilitate an investigation without informing such users.
 
We reserve the right to change, alter or modify these terms and conditions at any time.  By continuing to access the website you agree to be bound by the amended terms and conditions.  You should check from time to time to see if these terms and conditions have changed.
 
All information will be stored and processed pursuant to the Data Protection Acts 1988 – 2003 as required by law. Any personal information that you provide to us will be collected and held by us.  Under the Data Protection Acts you have rights of access to and correction of personal information that we hold.
 
We reserve the right to keep your information for use by connected companies; however, we will not provide this information to external parties with out prior approval from you. We may use the information provided by you on registration to verify the accuracy of that information including using the information to contact you whenever necessary.
 
We will only share personal information with other unconnected companies or individuals in the following circumstances:

You must ensure that any username and password you have as a user is kept secure and confidential and not revealed to any other person. Any instruction issued using your username and/or password will be deemed to be an instruction by you and may be acted upon accordingly until you notify us otherwise. You agree to notify us immediately of any unauthorised use of your username and/or password or any other breach of security. You waive any claim against us in respect of or arising from any reliance by us upon any use of your username and/or password, including us disclosing information relating to your registration and/or affairs with us.
 
You agree to indemnify and hold us and our officers and employees from any claims, actions, costs (including legal costs) or losses by us or any third party due to or arising out of:

    Reasonable reliance by us or any third party upon any acts carried out, requests made or information provided through the use of your account details (including your username and/or password);
    Your failure to complete any transaction that the Website may have facilitated;
    Your breach of any of these terms and conditions; or
    Any conduct of yours or any transaction entered into by you that does not comply with the relevant law.
    You receive loss or injury arising out of any deal you purchase from us not caused directly by us

The Consumer Protection Act 2007 may imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified. These terms and conditions must in all cases be read subject to those statutory provisions.
 
The Website may include links to other websites not owned by us. If you visit a linked website you will be subject to the terms and conditions of that website and any dealing will be solely between you and that other website and do not imply our endorsement of that other website or product or service being advertised.

If any portion of these terms and conditions is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.
 
All coupons/vouchers are fully transferable, subject to the agreement of the business providing the goods / services.  If you transfer the coupon the recipient is subject to the same terms and conditions and it is your responsibility to inform them of said terms and conditions.
 
You can opt-out of receiving email communications from us at any time by communicating with us and informing us that you wish to be removed from the mailing list.
 
These terms and conditions are governed by and will be construed in accordance with the laws of the Republic of Ireland and you submit to the jurisdiction of the courts of the Republic of Ireland.

Any personal information you provide may be used for the following purposes:
 
1.      To send you periodic emails that you have subscribed to through your nominated email address;
2.      To obtain feedback on a Deal you have purchased;
3.      To contact you;
4.      To verify your identity as a user of our website;
5.      To monitor and improve our website;

My Vouchers, Voucher Terms of Sale - Ireland

1. General Information

1.1 These Terms of Sale apply to every Voucher you purchase from My Coupons Ireland T/A My Vouchers.

1.2 MyVouchers means My Coupons Ireland Limited trading as My Vouchers, a company registered in Ireland and with its registered office at 1 Forest Green, Kingswood, Tallaght, Dublin 24, Ireland. Registration number is 531054 and its VAT number is IE3197599DH.

1.3 Voucher means an instrument, in either physical or electronic form, which entitles the holder of such Voucher (the “Voucher Holder”) to receive the Merchant Offering from the Merchant during the period of time stated on the Voucher (the “Redemption Period”).

1.4 The Merchant Offering shall mean the goods and/or services to be supplied and/or provided by the Merchant to the Voucher Holder, as specified on My Voucher’s Site and on the Voucher.

1.5 The Merchant is a third party unrelated to My Vouchers that sells, supplies and/or provides the Merchant Offering. My Vouchers does not sell, supply and/or provide the Merchant Offering. It only sells and supplies the Voucher.

1.6 These Terms of Sale were last updated on 01/05/2016. My Vouchers reserves the right to unilaterally amend these Terms of Sale at any time. All amendments to these Terms of Sale will be posted on-line. You will be bound only to the version of the Terms of Sale you agreed to at the time you purchase a Voucher.

2. Purchase of a Voucher

2.1 You must be at least 18 years old to purchase a Voucher. Before you can make a purchase you need to register and create an account with My Vouchers.

2.2 By clicking on the “Buy Now” button you submit an offer to My Vouchers to buy the Voucher. However, the purchase of the Voucher is not complete until you receive an email from My Vouchers confirming acceptance of your offer. My Vouchers expressly reserves the right to reject your offer. In addition, even if My Vouchers has accepted your offer, it can cancel the contract at any time if it reasonably suspects that you have committed or that you may be committing any fraud against My Vouchers, an affiliated third party of My Vouchers or the Merchant.

2.3 The Merchant may have its own terms and conditions applicable to the sale, supply and/or provision of the Merchant Offering.

3. Redemption of a Voucher

3.1 Unless expressly stated otherwise:

(a) the Voucher can only be redeemed once;

(b) the Voucher can only be redeemed with the Merchant and not with My Vouchers;

(c) the Voucher is valid for one person only; and

(d) you must follow the redemption instructions associated with the Voucher when you redeem the Voucher with the Merchant.

3.2 In order to redeem a Voucher you must present it to the Merchant within the Redemption Period. If you do not redeem the Voucher within the Redemption Period, the Voucher expires automatically and cannot be redeemed anymore.

3.3 In the event that a Merchant Offering on the My Vouchers Site is a “Direct Checkout” deal, My Vouchers will collect your shipping details at the time of purchase. My Vouchers will then pass these details to the Merchant on your behalf. The Merchant will then process the redemption of your Voucher and dispatch the Merchant Offering to you.

3.4 Unless expressly stated otherwise, the Voucher does not entitle the Voucher Holder to receive the Merchant Offering at a specific time. You are strongly recommended to contact the Merchant at an early stage. Doing so will give you the best chance of securing your preferred time for the supply and/or provision of the Merchant Offering. My Vouchers cannot influence the supply and/or provision of the Merchant Offering.

3.5 If you redeem the Voucher for goods and/or services other than the Merchant Offering, you will not be entitled to a credit, cash refund or new Voucher for the difference between the value of the Merchant Offering and the actual value of the goods and/or services supplied and/or provided by the Merchant to you.

3.6 Vouchers are redeemable in their entirety only. If, for whatever reason, you redeem the Voucher with a Merchant for less than the original (un-discounted) value of the Merchant Offering, you are not entitled to a credit, cash refund or new Voucher for the difference between the original (un-discounted) value and the redeemed value.

3.7 On behalf of the Merchant, My Vouchers may collect booking fees or other costs associated with the purchase and/or redemption of a Voucher. All such fees or costs (if any) will be communicated to you before you purchase the Voucher.

3.8 In the event that a Merchant cannot supply and/or provide the Merchant Offering as described for unforeseen reasons, My Vouchers will notify you as soon as possible by email. My Vouchers will offer you either a new voucher with comparable benefits (if available) or the repayment of the purchase price of the Voucher.

4. Use of a Voucher

4.1 Any purchase of a Voucher is for your non-commercial, personal use only (although you may give the Voucher to someone else for their non-commercial, personal use). The commercial trade of a Voucher is prohibited. The reproduction of a Voucher is prohibited.

4.2 Your Voucher is solely your responsibility. Neither My Vouchers nor the Merchant are responsible for lost or stolen Vouchers or for retrieving Voucher reference numbers or Voucher security codes.

4.3 You promise not to provide false data including false names, addresses and/or contact or payment details; or engage in any unlawful activity in connection with the purchase or use of a Voucher, or allow anyone else to do so.

4.4 The reproduction of a Voucher is prohibited.

5. Cancellation (and exceptions), Refunds and Problems

5.1 You have a statutory right to cancel your purchase of the Voucher within 14 calendar days after the day you receive the confirmation email (the “Voucher Cancellation Period”). However, if you redeem your Voucher during the Voucher Cancellation Period, you expressly request My Vouchers to begin providing the services to you, and you acknowledge that you lose your right to cancel the purchase of the Voucher. Since My Vouchers is not responsible for the supply or provision of the Merchant Offering, once your Voucher is redeemed My Vouchers has completed its services to you in full. Please note that, for the avoidance of doubt, this section also applies to all “Direct Checkout” deals.

5.2 If you want to cancel your purchase of a Voucher you can do so in any of the following ways:

5.2.1 by filling out and submitting the cancellation form online at here

5.2.2 by calling the customer service team at 01 5313681;

5.2.3 by emailing us at sales@myvouchers.ie; or

5.2.4 by writing us at the address mentioned in section 1.2.

5.3 If you cancel your purchase of the Voucher in accordance with this section 5, My Vouchers will refund you for all payments made as part of your purchase within 14 calendar days from the day on which you informed My Vouchers about your cancellation.

5.4 If you redeem your Voucher, but the Merchant has not properly provided you with the Merchant Offering, or if you have a complaint regarding the provision of the Merchant Offering, you must take action against the Merchant directly. This is because the Merchant, and not My Vouchers, is responsible for the supply and/or provision of the Merchant Offering. My Vouchers only sells and supplies the Voucher. However, if you and the Merchant cannot agree on how to resolve the complaint, My Vouchers may, upon your request, try to help resolve the issue between you and the Merchant.

5.5 Unless you expressly inform My Vouchers in advance not to, any refund in cash will be refunded to you via your original method of payment. If your original method of payment has been cancelled, expired or has otherwise changed, you must inform the customer support team immediately at https://www.myvouchers.ie/contact. If you fail to do this and you are refunded to your original method of payment, you may need to coordinate with your bank or your payment services provider to obtain your refund. My Vouchers will not provide more than one refund.

5.6 You have 30 days from the date you receive the refund to reject it. If you do not reject the refund during these 30 days, the refund shall be in full and final settlement of any and all claims you may have against My Vouchers related to, arising out of, or connected to that Voucher.

6. Responsibility for the Merchant Offering

6.1 Please note that the Merchant, and not My Vouchers, is:

6.1.1 the seller, supplier and/or provider of the Merchant Offering;

6.1.2 the party who enters into a contract with the Voucher Holder when the Voucher is redeemed; and

6.1.3 solely responsible for providing the Voucher Holder with the Merchant Offering and for the Merchant Offering itself.

7. My Vouchers Standards of Services and Liability

7.1 My Vouchers promises that:

7.1.1 it will exercise reasonable care and skill in performing its obligations under these Terms of Sale;

7.1.2 the Vouchers are of satisfactory quality and fit for their purpose; and

7.1.3 it shall not contravene the requirements of fairness or professional diligence in what it does.

7.2 My Vouchers is always liable for: (a) death and personal injury caused by My Voucher’s negligence; (b) fraud or fraudulent misrepresentation made by itself; or (c) any implied contractual terms that cannot be excluded or limited under applicable law.

7.3 Other than as set out in section 7.2 above, My Vouchers is not liable for any other losses or damages you may suffer, including any indirect or consequential losses.

7.4 My Vouchers does not promise the completeness, fitness for purpose or legality of the Merchant Offering. My Vouchers is not liable for the quality, safety, usability or any other aspect of the Merchant Offering.

7.5 My Vouchers is not liable for any breach of an obligation under these Terms of Sale where it is unable to carry out its obligations by any cause outside of its reasonable control.

7.6 Other than the liability arising under section 7.2, which is unlimited, My Voucher’s total liability to you will in no circumstances exceed the amount of 200% the purchase price of the Voucher.

7.7 In certain countries applicable law does not allow some or all of the exclusions and/or limitations set out in this section 7. If these laws apply to you, some or all of the above exclusions and/or limitations may not apply to you and you may have additional rights.

8. My Voucher’s Site

My Voucher’s Site (the “Site”) means the Internet website, mobile applications, electronic communications or services, or any location at which you can purchase a Voucher from My Vouchers including but not limited to the following websites that My Vouchers owns www.myvouchers.ie, www.myvoucher.ie, www.mycoupons.ie and www.mycoupon.ie. 9. Miscellaneous

9.1 If you breach these Terms of Sale and My Vouchers takes no action against you this does not mean that My Vouchers has waived its rights and remedies with regard to your breach. My Vouchers may still take action or exercise its rights and remedies for that action, or any other situation, where you breach your obligations under these Terms of Sale.

9.2 Unless otherwise stated within these Terms of Sale, notices to be given to either party shall be in writing and shall be delivered by electronic mail (other than if you are sending a notice to My Vouchers for the purpose of legal process) or by pre-paid post. Any notice My Vouchers sends to you will be to the address you supplied to My Vouchers when you registered for your My Vouchers account. You can send any notice to My Vouchers at the registered office address as set out in section 1.2.

9.3 If any provision of these Terms of Sale should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions of these Terms of Sale are not affected. Such invalid or unenforceable provision shall be replaced by a valid and enforceable provision which most closely achieves the economic effect contemplated by the invalid or unenforceable provision.

9.4 These Terms of Sale are governed and interpreted by the laws of Ireland, without regard to its conflict or choice of law principles. Exclusive venue for any dispute shall be the courts of Ireland.
